Presented with a highly complex set of facts students need to be able to identify clear-cut legal questions. They need to perform extensive research on these legal questions, analyse and prioritise the available resources, present their findings to the supervisors and the other student-members of the moot court team. After extensive discussion amongst the team about a thorough contriving on the question, students will process them into the written memoranda in the form of legal and factual arguments. Participation in the Willem C.Vis Moot Court trains students in formulating their arguments succinctly, cogently, and in a well-structured manner. The pleadings require students to develop and improve their oral skills. During both the written and the oral phase the team members need to work closely together. The developing of team spirit and acquiring the ability to work in a team is definitely also one of the aims of participation in the Willem C. Vis Moot Court.

Inhoud

The Willem C. Vis Moot Court is a prestigious international pleading competition in which teams from more than 50 countries worldwide participate. The moot is sponsored by a host of well-known institutions, including the International Court of International Commercial Arbitration (ICC) and the United Nations Commission on International Trade Law (UNCITRAL). In this moot court student simulate fictious international commercial arbitration proceedings. The students will act as attorneys of both the claimant and the respondent.

For the last five years, teams of students at the Amsterdam Law School have represented the UvA at this international competition. The Vis Moot takes place from October 2014 – March/April 2015 and consists of a written and an oral stage.

The first (written) stage will take place from October 2014  through January 2015 and commences on the first Friday in October when the problem, consisting of initial statements of claim and defence by the parties’ attorneys as well as motions regarding procedural questions and evidentiary exhibits, is distributed to the participating teams. According to an order by the Arbitral Tribunal both parties have to prepare a memorandum concerning factual and procedural issues. The memorandum supporting the position of the claimant is due early December. As the Vis Moot proceeds, each team is sent a copy of the memorandum for claimant of one of the other participating universities in the Vis Moot. The memorandum for respondent is prepared in response to the memorandum received, and is due mid January 2015.

The oral arguments take place in Vienna, Austria. They begin every year on the Saturday a week prior to Easter and close with the finals on Thursday of Easter week. Over the past two years the UvA was able to also participate in the Willem C. Vis East Moot Court, the Asian competition, held in Hong Kong.

As preparation for the oral arguments in Vienna, participating students will participate in several national and international pre-moots. Students will be supported during their preparation by various law firms and professionals. Meetings and trainings will take place at both the UvA and De Brauw Blackstone Westbroek, and other law firms.

On average, approximately 15 to 20 hours per week during the duration of the course, including time to prepare written submissions and frequent meetings with the team. Time consumption will be higher in the week(s) preceding deadlines for the two written memoranda.

Studiemateriaal

Literature on International Commercial Arbitration and on the Convention on the International Sale of Goods (CISG), dependent on the substance of the case.

Students will be graded on the basis of their oral and written pleadings.
