After having completed this course a student will:
- have a thorough understanding of the process of the Europeanisation of private law, including its political dimension;
- have a thorough understanding of the main characteristics of the developing multi-level system of private law in Europe, including the resulting coherence problems;
- be able to critically assess the strengths and weaknesses of various theoretical and policy approaches within the domain of European private law;
- have the skills and the knowledge to understand, interpret, implement, criticise and judge new developments in the field of European private law.
Inhoud
This course will provide an introduction to European private law. The main subjects will include: positive integration and consumer protection (sector-specific harmonisation and fragmentation; market functionalism; minimum and full harmonisation); negative integration and market freedoms (direct and indirect horizontal effects); fundamental rights (constitutionalisation; the example of equal treatment); the European Civil Code debate (principles, DCFR and CESL-proposal); legal traditions (common law v civil law; the example of good faith); philosophies of private law (commutative, distributive and social justice; the Manifesto); system & interpretation (harmonious interpretation; monism, dualism and pluralism; the example of immoral contracts).
