Leerdoelen

At the end of this course students will have a solid understanding of the European State Aid Law rules including the economic rationale behind these provisions and the enforcement framework. Students will be familiar with the legal and economic principles and problems related to the legal rules and institutional framework. Moreover, they will be able to apply the legal rules to specific problem areas and to critically analyze the current case-law of the EU courts as well as the Commission’s policy documents.

Inhoud

State aid rules form an integral part of any competition law regime and they are in particular key for the attainment of an efficient and competitive European market. This course deals with Articles 107-108 TFEU that contain specific rules for situations in which EU Member States grant financial aid or subsidies to certain undertakings or sectors of the economy. The Articles cover State aid granted in whatever form, which distort or threaten to distort competition and affect trade between Member States. The course deals in depth with the different substantive and procedural aspects of European State Aid Law by focusing on case-law and by discussing both the legal and economic principles related to the legal and institutional framework. The course also elaborates on the economic rationale of having state aid rules as well as provide a brief overview of state aid in the international context with special regard to the WTO.

Toetsvorm

Students are required to write an essay (approx. 15 pages) on one of the topics provided by the lecturer.
