At the end of this course, students must have insight in the functioning of the European Courts and a sound knowledge of legal procedures in EU Law. They must have an understanding of the differences in procedures under the TEU and the TFEU, the extent of the ECJ’s jurisdiction and be able to explain the position of the ECJ in relation to the Member States and other EU institutions, of the ECJ in relation to other international jurisdictions, the position of the individual before the ECJ, the position of the individual before the national courts: preliminary reference procedures. Students must know and be able to critically comment upon new developments under the Treaty of Lisbon (2007).
Inhoud
The jurisprudence of the European Court of Justice (ECJ) and the General Court (GC) plays a paramount role in the legal evolution of European law. Consequently, a sound knowledge of the European procedures is vital for legal practice.
The course focuses on the various existing dispute settlement procedures before the ECJ and the GC. It will cover,
inter alia, the preliminary ruling procedure, action for annulment, Treaty infringement procedures and action for damages. More specifically, the course deals with the architecture of the Legal remedies system of the European Union (EU), and the new developments resulting from the Treaty of Lisbon. In the process of exploring the (intricacies of the) different legal remedies, special attention will be given to the situations where there may still be said to be ‘gaps’ in terms of effective legal protection for the citizen.
